Lot Lottery Rules

Due to the unprecedented demand for new homes and the builders effort to meet construction timelines, Valencia Trails only releases lots via a lottery system.   The below rules are from a previous lottery and subject to change, but the in our experience the rules remain consistent.  For information about specific dates, deadlines, lots, deposits, etc. please contact Nick Nolan with MVP Realty at 239-977-4646 for more information.

LOT SELECTION DRAWING GUIDELINES

Thank you so much for your interest in Valencia Trails! These are the guidelines that will be used for your participation in the Valencia Trails Lot Selection Drawing broadcasted from the Valencia Trails Sales office via Zoom. If you want to take advantage of this exciting opportunity, the policies and procedures below will apply to the Lot Selection Drawing. If you are interested in general sales and product information about Valencia Trails and you are not participating in the Lot Selection Drawing, please contact Nick Nolan 239-877-4646.

Please read all of the following to make sure you are familiar with how the lot selection process will proceed on Wednesday morning.

1.Priority Order Determined by Random Lot Selection Drawing. The order for buyers to purchase a home will be established by a random Lot Selection Drawing that will be broadcast via Zoom.  Participants selected will have the opportunity to purchase one of the available lots at Valencia Trails as more fully discussed below.

2.Pre-Registration for the Lot Selection Drawing. To be eligible to participate in the Lot Selection Drawing, a Pre-Registration will take place (2 days before the event). During the pre-registration period, it will be necessary for you come to the Valencia Trails sales office to deliver a reservation deposit check in the amount of Five Thousand Dollars ($5,000.00) made payable to “Valencia Trails” and fill out the reservation paperwork that will be used at the drawing, which will include (a) a Buyer Reservation Form, (b) a Reservation Deposit Form and (c) a Disclosure Summary for the Valencia Trails Homeowners Association. If you cannot visit the sales center in person during the pre-registration period, please call us to make arrangements to have your reservation deposit check and paperwork delivered to us before the end of the pre-registration period.

A Zoom link will be provided to all participants upon the verification and receipt of all required pre-registration documents and the reservation deposit.

Please be aware that the reservation deposit check must be from an account in the actual name of the buyer purchasing a lot (NO THIRD-PARTY CHECKS OR CREDIT CARDS WILL BE ACCEPTED - including trust checks, company checks, in trust for or other non-personal checks). The reservation deposit will be fully refundable if you do not select a lot or do not subsequently enter into a contract for purchase of a home.

3.Lot Selection Drawing and Process. Buyers will be allowed into the Zoom Meeting to view the Lot Selection Drawing. The Lot Selection Drawing will begin to establish the priority order for buyers to purchase a home in Valencia Trails. At that time, a random drawing of names will take place from all potential buyers who pre-registered as described above. Once the priority order for buyers has been established, your sales agent will call you on the phone number provided on your Reservation Deposit Form. You will have four (4) minutes to ask any questions and select an available lot and home.

4.Unable to Virtually Attend. If for any reason you are unable to virtually attend in the Lot Selection Drawing you may provide a phone number of a representative to virtually attend in your place, but we must have timely received in our office your $5,000 reservation deposit check and your fully completed reservation paperwork during the pre-registration period. If you are represented by a broker, your broker may act as your lot selection representative, however, a broker may only act as a lot selection representative for one buyer at the drawing.

5.One Drawing Spot Per Immediate Family. Lot drawing spots are not transferrable so whatever number is given out to a buyer, the person(s)/couple with that selection number are the ones that will have the opportunity to go to reservation and contract. Only one lot drawing spot per immediate family will be given out. If it is determined that any person or immediate family received more than one number for the drawing, their entry(s) will be cancelled.

6.Contract Execution.After you have selected a home and lot, you will be contacted by the sales office to schedule a contract signing appointment to execute the Purchase Contract for the purchase of the home and lot. The contract signing appointment shall take place within 24 hours of the Lot Selection. A deposit of ten percent (10%) of the total purchase price (base house price plus lot premium), less the $5,000 reservation deposit, will be required to be paid at the time of execution of the Purchase Contract. You will receive a sample copy of the Purchase Contract and association documents at the time of your registration to provide you an opportunity to review and become familiar with them prior to your execution of the Purchase Contract, including, without limitation, the provisions regarding the NO INVESTOR POLICY described below. Please be aware that additional monies will be required to be paid at the time of selection of options and upgrades in accordance with the Purchase Contract.

7.Brokers. If you are being represented by a broker, your broker must have accompanied you at your first visit and completed a Broker Registration Form or they will not be recognized as your broker. The broker will also be required to enter into a Broker Participation Agreement with us at the time of execution of your Purchase Contract. Brokers interested in purchasing a lot for himself/herself, may do so, but may only purchase one lot and must otherwise abide by all of the above procedures like any other buyer.

8.No Investor Policy. You may only purchase one lot in Valencia Trails, and you must intend to purchase the home as your primary residence in Florida (but it does not necessarily need to be your primary residence). The Purchase Contract is not assignable or transferrable. The Reservation Deposit Form and Purchase Contract will require you to make certain representations regarding your purchase and will contain certain agreements to limit your ability to list or advertise the home for sale prior to closing. In addition, in the event you sell the home within one (1) year after closing, 100% of the gain realized from such sale shall be paid to the Seller from the proceeds of such sale, except for a sale resulting from a hardship event that is documented and approved in writing by Seller (i.e., divorce, job transfer out of the area, or other reason acceptable to Seller). Any breach will be considered a default under the Purchase Contract which will provide the Seller with the right to terminate the Purchase Contract and retain all deposits and other monies paid by you. These restrictions and obligations will be contained in a deed restriction recorded at closing. A summary of the No Investor Policy is included with the reservation documents.

WHERE IS VALENCIA TRAILS LOCATED?

Valencia Trails Is located off lmmokalee Road, east of 1-75 In Collier County at 11256 Daphne Court, Naples, Florida 34120. Valencia Trails is designed for residents aged 55 & older and Is intended to meet the exemption under the Federal Fair Housing Act.

HOW MANY SINGLE FAMILY HOMES WILL BE BUILT AT VALENCIA TRAILS?

It is anticipated there wi1 be a total of 836 single family homes at Valencia Trails.

WHAT IS THE TOTAL ACREAGE OF VALENCIA TRAILS?

HOW AND WHEN CAN I GET PRE-APPROVED WITH GL FINANCIAL?

A $5,000 reservation deposit is required to reserve a lot. The reservation period will expire after three (3) days. A deposit of 10% of the purchase price (less the $5,000 reservation deposit) will be required to be paid upon execution of the Purchase Contract.

The checks should be made payable to “Valencia Trails” or “Naples Associates IV, LLLP” and must be in the name of the buyer and drawn on a US financial institution. No third-party checks and no credit cards will be accepted.

WHAT TYPE OF RECREATION FACILITIES DOES THE DEVELOPMENT OFFER?

WHAT ARE THE ASSOCIATION MAINTENANCE FEES?

The estimated assessments for owners is approximately $456.00 per month (collected by the Association in quarterly amounts of $1,368.00). These estimated assessments are subject to change. In addition to the assessments, an annual food and beverage allowance in the amount of $500.00 per household will be assessed and collected on January 1st of each calendar year. This allowance will be for each household’s restaurant account and must be used before the end of the calendar year (i.e., unused balance will not be refunded or carried over to the following year). This allowance is subject to change and/or discontinuance at any time.

IS THE DEVELOPMENT GATED?

A gatehouse will be constructed at the main entrance off Immokalee Road. This gatehouse covers one lane of the incoming traffic. The gatehouse will have three traffic lanes restricting vehicular access. The guest, resident and exit lanes will feature automatic arms operated by an access mechanism. The guest gate may operate by a gatehouse attendant or telephonic control for guest access. The HOA will determine whether to staff the gatehouse and the timing of the staffing.

CAN WE RENT THE HOME AFTER WE CLOSE?

The HOA Documents restrict rentals to no more than one (1) time in any twelve (12) month period. All leases should provide a minimum lease term of seven (7) months. 

No Owner may lease the Home unless at least one of the intended occupants is fifty-five (55) years of age or older at the time of the occupancy. Any Owner who leases the Home shall submit an age verification form to the HOA prior to the effective date of such occupancy. The Board, however, shall have the right, in its sole discretion, to waive this requirement based upon criteria included in the Declaration but not if more than twenty percent (20%) of the Homes will not have at least one occupant fifty-five (55) years of age or older.

WILL THERE BE A CDD?

There will not be a CDD at Valencia Trails.

WILL THERE BE GAS IN THE COMMUNITY?

Yes, the hot water heater, dryer and range will be gas.

ARE POOLS BEING OFFERED?

Yes as an available option for purchase, and nearly all home sites can accommodate a pool. Please see sales agent for more details.

WILL YOU ALLOW INVESTORS?

No. A No Investor Policy will be implemented at Valencia Trails. Therefore, you may only purchase one lot in Valencia Trails.
